“O Canada! Station” initiative
The O Canada! Station was designed to allow Canadians to express their pride in being Canadian, as part of a national participatory initiative. Submitted videos could be used in official Canadian Heritage communications, including during the national Canada Day broadcast (the “Project”).
Anyone wishing to submit a video must read the terms of use and this licensing, consent and waiver form, agree to the terms and sign it.
I, the undersigned, hereby authorize His Majesty the King in Right of Canada, as represented by the Minister of Canadian Heritage, to collect, retain, use, reuse, transform, adapt, modify, crop, produce, reproduce, disclose, publish, republish, distribute to the public, communicate to the public, publicly exhibit, preserve, translate, retain, archive, combine with other videos, images or content, and disseminate without restriction any photos, motion pictures, videos, recordings of my image, images of my appearance, voice and performance, as well as my comments, whether audio, digital or otherwise (the “Videos, Photos and Content”) produced by His Majesty or the Minister, their legal representatives, employees or any person acting on their behalf, either at their request or under their direction or supervision, including in any publication, broadcast, social media platform, advertisement or poster, on any media including television and the Internet (the “Use of the Videos, Photos and Content”). I understand that there may be no Use of the Videos, Photos and Content. I further understand and agree that my name may be disclosed in connection with the Videos, Photos and Content.
I hereby grant His Majesty the King in Right of Canada, as represented by the Minister of Canadian Heritage, a free-of-charge, non-exclusive, worldwide, royalty-free licence for the Use of the Videos, Photos and Content described above and for the sub-licensing of the Videos, Photos and Content for the purposes of the Project. In addition, I hereby waive, to the fullest extent permitted by law, the exercise of all my moral rights relating to the Videos, Photos and Content, without restriction.
I agree not to receive any remuneration or other form of payment of any nature whatsoever in connection with the Use of the Videos, Photos and Content for the purposes of the Project.
I, the undersigned, release and discharge His Majesty the King in Right of Canada, as represented by the Minister, their legal representatives, employees or any person acting on their behalf from any and all claims, liabilities, losses and damages of any kind that I may have, now or in the future, arising out of or relating to my participation in this Project or the Use of the Videos, Photos and Content.
Privacy notice
The collection of personal information is authorized by section 4(2)(k.1) of the Department of Canadian Heritage Act and is required to operate the O Canada! Station. Collection and use of this personal information are in accordance with the Privacy Act. This information will be used to confirm the participant’s consent, verify the video content is in line with the terms and conditions and enter the participant in the drawing of prizes provided by VIA Rail. The personal information collected is described in Personal Information Bank PSU 938 – Outreach Activities and will be retained for 12 years. If the requested information is not provided, your submission may not be considered. Under the Privacy Act you have the right to access and correct your personal information.
